 Who is BFMIC?

The Bermuda Fire and Marine Insurance Company Limited (in Liquidation).

An insurance company incorporated in Bermuda.

In the context of the Scheme of Arrangement also referred to as the "Company".

A "Scheme of Arrangement" is a binding compromise under section 99 of the Companies Act 1981 of Bermuda and section 425 of the United Kingdom Companies Act 1985.

Once a Scheme is approved by the majority of its creditors and the court it is binding on all creditors.

 About this website

This website is designed to offer information relating to BFMIC, its run-off management company KMS Insurance Management Limited (“KMSIM”), the BFMIC Scheme of Arrangement and the closure of the BFMIC estate.

Through the use of the various "tabs", information can be found relating to the history of BFMIC and Documents, ranging from the Creditor Reports to the Revised Scheme Document.

 Claims Submission Bar Date

The 29 September 2004 Bar Date for submitting your Claim Form has now passed.

 Latest News

The current payment percentage is 90% with the last distribution made in July 2009.

A final payment is expected in 2012.

If you have received prior payments and you have changed address recently you should inform KMSIM, the company's run-off agents. Details can be found in the Contacts tab.

 Amending Scheme

The final version of the Scheme Document, dated and sent to Creditors on 15 April 2004, is published in the Documents tab. Hard copies or a cdrom version can be obtained from the Creditor Helpdesk at the address shown in the Contacts tab.

Those General and Protected Scheme Creditors whose claims were admitted for voting purposes unanimously approved the Amending Scheme at Meetings held in Bermuda on 18 May 2004.

The Bermudian and English courts sanctioned the Amending Scheme on 18 June 2004. The US Bankruptcy Court issued a revised S304 Permanent Injunction Order on 23 June 2004. Copies of the court orders are included in the Documents tab.

The Amending Scheme became effective on 25 June 2004 and the Bar Date, by which time the Liquidators must have received details of your claim and ALL supporting information, was 23.59 GMT on 29 September 2004.
